Privacy Policy

Version of September 2026

With this privacy policy, migrationhelp (Idastrasse 17, 8003 Zurich, Switzerland) (hereinafter we or migrationhelp) informs you how we collect, use, disclose and otherwise process personal data. This description is not exhaustive; individual matters may additionally be governed by separate statements or agreements. Personal data means any information relating to an identified or identifiable natural person.

Unless we inform you otherwise in an individual case, migrationhelp is responsible for the processing described in this privacy policy. For data protection matters, you can reach us at the following contact address:

We process personal data that we receive from you yourself, from our clients and their family members, from authorities, courts or other third parties (for example opposing parties), that arises in the course of an initial contact, a consultation or an engagement, or that we collect through our website and contact forms. Where permitted, we may also obtain information from publicly accessible sources.

The categories of personal data processed include in particular:

  • Personal details and contact data, such as name, address, phone number, email address, date of birth, nationality, country of origin, marital status, family circumstances.
  • Information on the engagement, such as procedural documents, correspondence with authorities and courts, authorisations, fee agreements.
  • Communication data, such as email and telephone correspondence, messages via WhatsApp, information from the contact form.
  • Particularly sensitive personal data, where necessary for handling the case, in particular information on health, religious or political beliefs, ethnic origin, criminal proceedings or reasons for flight.
  • Financial information, such as invoicing and payment data, information on financial need in connection with applications for legal aid.
  • Information from the use of our website, such as IP address, browser type, pages visited, date and duration of the visit.

We process personal data in accordance with applicable data protection law for the following purposes:

  • To perform the engagement: processing in connection with accepting and carrying out engagements, including legal representation, legal advice and correspondence with authorities and courts.
  • To comply with legal obligations: in particular retention and documentation obligations and obligations towards supervisory authorities.
  • To protect legitimate interests: for example to further develop our website and services, to communicate with enquirers, to assert or defend legal claims and to maintain secure business operations.
  • Based on your consent: for example where you expressly agree to processing by AI-assisted tools in accordance with section 4, or when signing up for communications. Consent given can be withdrawn at any time without affecting processing that has already taken place.

To support the initial assessment and preparation of cases, we additionally use AI-assisted software. The following applies:

Purpose: The AI-assisted evaluation serves exclusively for our internal preparation and initial assessment. It does not replace the independent legal review and decision by the responsible legal representative.
Cross-border processing: The software used is operated by a provider based outside Switzerland and the EU/EEA. Your personal data is processed abroad only where this is necessary for the specific case analysis, and only after prior information or after obtaining your express consent, in particular where particularly sensitive personal data is concerned (Art. 6 para. 7, Art. 16–17 DSG). Where possible, we make sure that the provider offers appropriate contractual safeguards (e.g. standard contractual clauses).
Professional secrecy: Client confidences are passed on to the service providers used only to the extent permitted and in compliance with our professional duty of confidentiality (Art. 13 BGFA). We document which documents are processed for which purpose and limit disclosure to what is necessary for the respective case analysis (data minimisation).
Storage: Analysis results and file notes derived from them may be stored internally on a permanent basis. Original documents are not processed externally for longer than necessary for the respective analysis.

You have the right to object, in an individual case, to the processing of your documents using AI-assisted tools; in that case the case is handled exclusively by our staff in person.

Our website uses technically necessary cookies and an analytics tag (Google Tag/Google Ads conversion tracking) to record how our website is used and whether contact was made through our form. No content of your enquiry is recorded, only anonymised usage and event data.

You can restrict or prevent the use of cookies in your browser settings; this may impair the functionality of the website.

We may disclose personal data to the following categories of recipients:

  • courts, authorities and administrative bodies in the course of handling the case (e.g. SEM, Federal Administrative Court, cantonal migration authorities);
  • specialists, interpreters or other legal representatives whom we involve, where necessary for the engagement;
  • service providers who support us with website hosting, email and the AI-assisted case analysis in accordance with section 4 and who act as processors.

Recipients of personal data may be located in Switzerland or abroad, in particular where our service providers (e.g. hosting and AI providers) operate their infrastructure. If data is disclosed to a country without a level of data protection recognised as adequate by the Federal Council, we ensure that this takes place only on the basis of a suitable justification, in particular:

  • you have expressly consented;
  • the disclosure is necessary to perform the engagement with you;
  • appropriate contractual safeguards exist (e.g. standard contractual clauses of the European Commission).

You can request a copy of any contractual safeguards via the contact address given in section 1.

We process and store personal data for as long as is necessary for the respective purpose of processing, generally for the duration of the engagement and beyond that where statutory retention obligations or limitation periods require it or where there is a legitimate interest in continued retention. Personal data that is no longer needed is deleted or anonymised.

We take appropriate technical and organisational measures to protect personal data against unauthorised access and misuse, for example through access restrictions, encrypted transmission, careful selection of our service providers and data minimisation when using AI-assisted tools.

In accordance with the applicable law (in particular the Swiss Federal Act on Data Protection and, where applicable, the EU General Data Protection Regulation), you have the right of access, rectification and erasure of your personal data, the right to restriction of processing, the right to object and, where applicable, the right to data portability. We reserve the right to invoke restrictions provided for by law, in particular where we are bound by a duty of confidentiality (professional secrecy) or need data to protect our own claims.

To exercise your rights, contact us using the contact details given in section 1. You also have the right to lodge a complaint with the Federal Data Protection and Information Commissioner (www.edoeb.admin.ch).

We may amend this privacy policy at any time. The current version published on this page is the authoritative one.
