High-net-worth individuals who do not intend to work in Switzerland usually face two questions at the same time: the residence-law question (under which conditions do I obtain a permit without working here) and the tax question (which canton suits my situation). Both questions are closely linked and should be examined together from the outset.
An important point, often unknown, up front: not every canton is an option
We say this deliberately and openly at the outset rather than keeping quiet about it: as a law firm based in Zurich, we equally advise on relocations to other cantons. Choosing the right canton is in any case the first and most important step of the whole planning, regardless of where the advising firm has its own seat.
Residence-law basis: residence without gainful activity
The residence permit is granted on the basis of Art. 30 para. 1 lit. b AIG (residence without gainful activity) or, for persons of retirement age, Art. 28 AIG. The cantonal authorities examine in particular whether sufficient financial means for living without gainful activity are proven and whether there is a special connection to Switzerland or a cantonal interest in the settlement.
Tax basis: taxation according to expenditure
The tax base is not worldwide income but annual living expenses (at least seven times the rental value of the occupied property), with a federal minimum tax base (2026: CHF 434,700). The requirements under Art. 14 DBG include, among others:
- No Swiss citizenship
- No gainful activity in Switzerland; even a paid board mandate or employment in your own Swiss company can jeopardise the status
- First-time establishment of tax residence in Switzerland, or return after at least ten years abroad
Family members
Spouses and minor children can generally follow under family reunification; we discuss the relevant deadlines and evidence in depth in our article on family reunification for executives and high-net-worth individuals.
How we support you
Together with you we examine which canton is realistic for your specific situation, coordinate the residence-law side with your local tax adviser and support the application through to the decision. Advice is given discreetly and, on request, in German, English or French.
