When an international group relocates an experienced executive or specialist to its Swiss branch for a limited period, the intra-company transfer is regularly the appropriate legal framework — it is tailored to exactly this situation and differs from an ordinary external new hire.

Legal basis: Art. 46 VZAE

The intra-company (operational) transfer eases the admission of persons who are already employed by a foreign group company and move to the Swiss group company for a fixed-term assignment. Typical situations:

What the authorities look at

With an intra-company transfer too, the general requirements for third-country nationals remain relevant — in particular the annual quotas (Art. 20 AIG) and proof that the position is actually filled by a qualified person already employed within the group, and not as a way of circumventing the ordinary recruitment obligations. Clear contractual documentation of the group relationship and of the fixed-term nature of the assignment is also essential.

EU/EFTA group companies: a separate, simpler route

For executives who move to Switzerland from a German, French or other EU/EFTA group company and are themselves EU/EFTA nationals, the intra-company transfer under Art. 46 VZAE is regularly not the relevant route; the considerably simpler Agreement on the Free Movement of Persons applies instead — without a quota check. The intra-company transfer has its practical importance above all where the transferred person is themselves a third-country national, irrespective of the seat of the sending group company.

Practical planning for recurring transfers

Groups with regular rotations into the Swiss team benefit from a clean, reusable documentation structure (templates for secondment contracts, proof of the group relationship) that does not have to be redeveloped for every single transfer.
